The Superior Court of New Jersey Appellate Division has ruled that a man injured while on a coffee break is entitled to full disability benefits. The foreman plumber was injured shortly after leaving union hall in a company vehicle to discuss a project with a union instructor. The instructor was busy, though, so the man took a coffee break. He was on the way to get coffee when he was involved in an accident that resulted in compound fractures in both legs and an arm. Although his employer argued that he wasn’t entitled to disability benefits because he was not at work, the courts ruled that his authorized use of a company vehicle at the time of the accident warranted 100% disability benefits.

The man was working at TeligentEMS in Havana on Dec. 9 when a barrel exploded on him. He had been using a blow torch on this barrel to cut through it. The barrel had alcohol residue on it. He was being treated in the hospital for third-degree burns, but he died on New Year’s day.

The accident occured around 8 a.m. at an oil rig in Oklahoma. According to officials, oil rig workers were lifting a pipe when it suddenly broke loose. The 3,000-4,000 pound pipe fell on a trailer, sliced through the top and hit a 35-year-old worker who was inside. He died instantly. The Occupational Health and Safety Administration is doing a full investigation into this fatal workplace accident.
