Worker to recieve benefits from smoke-break injury

The Oklahoma Court of Civil Appeals has reversed an appeal that stated that a woman would not receive benefits after being injured at work because she was on a smoke break when the incident occurred.

The appeals court found that the woman deserved to receive workers compensation because the injury happened in an employer-designated area.

The woman arrived at work early in order to avoid traffic on icy roads on the way to work. After going to her workstation and turning on her computer she went to an employee area for a smoke break. As she walked back to her area, she slipped and fell.

The woman is claiming that injured her left side, knee and back. The trial court denied benefits, but the appeals court reversed it claiming that it was similar to other cases where benefits were granted.
