An explosion in a mine owned by Massey Energy Co. in West Virginia on Monday has killed 25 people.

Four miners are still missing after the blast, which occurred about 30 miles south of Charleston. Safety officials report that the mine had a history of violations for failure to properly ventilate methane, the highly-combustible gas that likely played a role in the explosion. Fourteen of the victims have still not yet been identified. The explosion has become the deadliest mining disaster in the United States since 1984.

The 35-year-old worker was working in the ditch around 2:30 p.m. on Thursday when a coworker attempted to connect a front bucket to a backhoe. The bucket then slid down the side of the ditch to where the worker was located. Luckily, the bucket did not fall on top of the worker, but trapped the worker for 2 hours as rescue crews tried to get him out of the hole. He was transported to a nearby hospital in critical condition.

According to the state’s Insurance Department, Eagle River, Inc, had already paid $150,000 of the debt. An audit by state investigators showed the discrepancy, which the company had been exploiting in order to pay lower insurance premiums.

The Superior Court of New Jersey Appellate Division has ruled that a man injured while on a coffee break is entitled to full disability benefits. If you or someone you love has been injured at work and isn’t getting the disability compensation he or she deserves, the New Jersey workers compensation lawyers of Levinson & Axelrod may be able to help.

The foreman plumber was injured shortly after leaving union hall in a company vehicle to discuss a project with a union instructor. The instructor was busy, though, so the man took a coffee break. He was on the way to get coffee when he was involved in an accident that resulted in compound fractures in both legs and an arm. Although his employer argued that he wasn’t entitled to disability benefits because he was not at work, the courts ruled that his authorized use of a company vehicle at the time of the accident warranted 100% disability benefits.
