If you or someone you love has been injured at work and isn’t getting the disability compensation he or she deserves, the New Jersey workers compensation lawyers of Levinson & Axelrod may be able to help.
The foreman plumber was injured shortly after leaving union hall in a company vehicle to discuss a project with a union instructor. The instructor was busy, though, so the man took a coffee break. He was on the way to get coffee when he was involved in an accident that resulted in compound fractures in both legs and an arm. Although his employer argued that he wasn’t entitled to disability benefits because he was not at work, the courts ruled that his authorized use of a company vehicle at the time of the accident warranted 100% disability benefits.

A new study published by the University of Illinois at Chicago School of Public Health found that the cost of workers compensation for Illinois construction workers is mostly dependent on the severity of the injury, not the cost of legal fees. If you or someone you love has been injured and isn’t getting the money they deserve, the New Jersey workers compensation lawyers of Levinson & Axelrod may be able to help.
The study evaluated nearly 20,000 claims in Illinois filed between 2000 and 2005 for several different details, and found that the cost of legal fees – long claimed by detractors of the system to dramatically increase the cost of workers compensation – actually have a very small effect on the cost of workers compensation. Instead, it is the severity and extent of the injuries sustained by the worker that most effects the compensation requirements.

Employers across the country have been misclassifying employees as independent contractors in order to avoid paying them money and benefits they’re owed. If you or someone you love has been denied workers compensation you deserve, the New Jersey workers compensation lawyers of Levinson & Axelrod may be able to help get you the money you’re owed.
Legislators across the company are considering ways to cut down on the illegal misfiling of workers as independent contractors. New Jersey, New York, and Montana recently brought litigation against FedEx for these practices, and more suits are almost certainly on the horizon.
In addition to hurting workers who are not getting the benefits they deserve, this illegal practice allows companies to undercut competitors, meaning that other companies and their employees suffer as well.

Levinson & Axelrod has learned of a study conducted by the National Employment Law Project, the University of Illinois, and UCLA which found that low-wage workers are being encouraged not to file for the workers compensation money they’re owed. If you or someone you love is being pressured into not filing for workers compensation, the New Jersey workers comp lawyers of Levinson & Axelrod may be able to help you get the money you deserve.
The study found that employers regularly and systemically violate both federal and state labor laws. Additionally, only 8% of low-wage employees who experienced serious on-the-job injuries filed a workers compensation claim. Even when the workers told their employers about their legitimate injuries, 50% experienced an illegal reaction: being fired, being told not to file for workers compensation, and even having immigration authorities called in.
